Immigration Law Overview

In the United States, immigration laws bear political overtones because they touch on the sensitive issues of national sovereignty and homeland defense. These laws dictate who may enter the country, as well as the length and duration of their visit. These laws also allow selected non-citizens to naturalize and become citizens of this country.

U.S. Immigration Laws

U.S. immigration laws treat persons as either U.S. citizens or aliens. The Fourteenth Amendment states that U.S. citizens include "persons born or naturalized in the United States, and subject to [its] jurisdiction." Therefore, all persons who are not U.S. citizens are aliens. 28 U.S. Code Section 1101.

In terms of aliens, U.S. immigration law further classifies them according to their immigration status, with each group afforded different rights and obligations, such as the right to reside in the United States, the right to sponsor relatives, and the right to work in the United States. Aliens may be lawful permanent residents (i.e., green card holders), immigrant visa holders, temporary lawful visitors or undocumented illegal aliens.

  • Beyond law blogs.
Image from Library of Congress's website. Anne Reed invited me and four other blawgers to list five of our favorite non-law blogs. she was tagged by another blawger for such a list, but I end my link of the chain letter here, never having sent out such messages before. Instead of listing just five blogs, I list one set of blogs that are far removed from the law, and another set that deals with public policy and legal issues from outside the lawyering realm. In any event, my favorite reading...

I replied: I am curious why some or many think McCain was a war hero. I ask this for the following reasons: - On the one hand, he cannot be accused of selfishly avoiding wounds and death in war, because...

  • San Diego Immigration Lawyer - Marriage Based I-485 Approval Even after Divorce
Most of our readers are aware that any adjustment of status in a family based petition can not be approved if the relationship is no longer viable. Yet there are certain exceptions from time to time. On August 12, 2008, in Choin v. Mukasey, the U.S. Court of Appeals for the Ninth Circuit ordered the Board of Immigration Appeals (BIA) to consider Ms. Choin's Form I-485 Application for Adjustment of Status based upon marriage, even though she was no longer married to her U.S.-citizen husband. The...
