- Federal Court of Appeals Affirms Sentences in Theft of Trade Secret Case
Posted May 14, 2008, 4:12 pm
In a federal criminal case that was prosecuted in Atlanta, Georgia, the Eleventh Circuit Court of Appeals recently affirmed the sentences of two individuals convicted of conspiracy to commit theft of trade secrets. This federal case received a lot of media attention because it involved an allegation that a Coca-Cola Company employee and others attempted to sell confidential documents and materials to one of Coke's main competitors, Pepsi. After learning of the alleged scheme, an FBI agent posed...
- Traumatic Brain Injuries Are On The Rise
Posted May 14, 2008, 3:14 pm
In our personal injury practice, we have seen evidence here locally of what has been documented to be a growing and national problem. We have seen more and more brain injury cases resulting from traumatic events, typically tractor-trailer accidents, automobile accidents or some other traumatic incident, many times caused by the negligence of a third party. We have also seen these cases in the context of serious on-the-job injuries. What we see here in our practice mirrors the growing nature of...
- Georgia Estate Planning and Probate Law: Why Do I Need a Will?
Posted May 13, 2008, 5:05 am by Stephen Worrall
Introduction Few people enjoy estate planning. This is one reason so many lawyers die without wills. Estate planning is uncomfortable, but you should consider it a labor of love for your family and friends. What you do or fail to do now, may significantly simplify or complicate the tasks for your family and friends after you have passed on. Estate planning is often thought of as relating solely to tax planning. In reality, providing for beneficiaries, and determining who will care for children...

- Doctor Sues for Medical Negligence
Posted May 12, 2008, 12:49 pm
Our Atlanta personal injury lawyers constantly hear calls form doctors and politicians to limit the rights of recovery of innocent patients injured by medical negligence. Often, the rights of these innocent patients are sacrificed for the monetary benefit of physicians and big insurance companies. One need look no further than the so called "tort reform" package passed by the Georgia legislature in 2005 and later signed into law by Governor Perdue. Doctors are quick to support this erosion of...
- The Importance of Reporting Your Injury Completely and Thoroughly and Why an Incomplete Report Can Damage Your Case
Posted May 12, 2008, 11:59 am by Jodi Ginsberg
One of the issues that I sometimes face arises from my client's initial report of his injury. When you are hurt on the job, you can help your case greatly by thoroughly and accurately reporting your injury. Don't just talk about the one injury that is hurting you right now. Instead, take an "inventory" of every part of your body that was involved. Don't exaggerate, but don't minimize problems either. For example, if you fell off a ladder, you might have immediate back pain. But, you might also...
- High-Speed Police Chases: One Person Can Make A Difference
Posted May 12, 2008, 11:20 am
On our blog, we have written numerous articles about the dangers associated with high speed police chases. Our firm has handled numerous wrongful death and serious injury cases arising out of these very dangerous pursuits. By and large the public does not appreciate just how dangerous police chases are. Indeed, more people are killed each year from police chases than are killed as a result of police firearm incidents. Over the last ten (10) years more people have died in police chases than were...
- Brain Injuries and the Uninsured
Posted May 9, 2008, 9:36 am
The saddest personal injury cases we see in our serious injury law practice often times involves those who have suffered traumatic brain injury resulting from an automobile, tractor-trailer collision or some other traumatic event, with these tragedies being seriously compounded by the unavailability of insurance. While there has been some media attention on the number of uninsured individuals in this country who have no available health insurance coverage, the impact of this problem is not...
- Federal judge in Arkansas shells the corn about overreaching federal preemption
Posted May 9, 2008, 4:07 am
As an Atlanta lawyer handling both defective product and motor carrier cases, I have been troubled over the past several years by a trend of federal agencies seeking to block juries from ever getting a chance to consider the evidence against manufacturers through the doctrine of federal preemption, often beyond anything expressly intended by Congress. Unfortunately, the U.S. Supreme Court has been lending support to that doctrine. Now, however, U. S. District Judge William R. Wilson, Jr., in...
- Insulin Pump Dangers
Posted May 8, 2008, 2:49 pm
Federal regulators are sounding a warning about dangers associated with the use of insulin pumps by children and teenagers. Insulin pumps are used by tens of thousands of young people worldwide with Type 1 diabetes. The Food and Drug Administration is warning parents to be vigilant in watching their children's use of the pumps. They are not advising against using the pumps, but suggested further study to address safety concerns in teens and even younger children who use the popular pumps....
- Feds grant funds for study of Integrated Vehicle-Based Safety System

Handling trucking accident injury cases in Georgia, I see the aftermath of plenty of crashes that could have been avoided if drivers had a timely "wakeup call." Now the National Highway Transportation Safety Administration, Federal Motor Carrier Safety Administration and several corporations are funding a University of Michigan study of a high-tech system to help car and truck drivers avoid crashes by warning them of potential road dangers and assessing their options. The Integrated...

As reported by Reuters, Ken Okada, a former stockbroker with Bear Stearns, was sentenced on Tuesday to three years probation, a year of home confinement, and fined $300,000 for his role in an insider-trading scheme. Okada was one of 13 people charged in 2007 in what authorities have called the most pervasive insider trading rings since the 1980s. Okada used information from UBS AG research reports, before the reports were made public, to execute hundreds of trades totaling $17.5 million.
- $18 million settlement in four-fatality Missouri truck wreck
Posted May 8, 2008, 4:42 am
As a Georgia trial attorney handling trucking accident cases, I see too many instances of truck driver fatigue and drug usage leading to tragedy. The pattern is exemplified in a Missouri case. It has resulted in an $18 million settlement for the deaths of four family members (ages 55, 57, 81 and 94) on the way to a 50th wedding anniversary celebration. The truck driver had less than the required amount of rest the night before, according to subpoenaed cell phone records, and was on eight...
- 31% of tractor trailers have out of service safety violations in Arizona sweep
Posted May 7, 2008, 10:07 pm
As an attorney handling trucking accident cases in Georgia, I've seen a wide variety of violations of trucking safety rules. It's a nationwide problem. In 60,000 random inspections of tractor trailers in Arizona, 31% yielded safety violations serious enough to take the truck out of service. Fully 86% turned up at least one safety violation. That's according to a report by Joe Ducey at KNVX-TV in Phoenix. The breakdown of violations in the Arizona report is as follows: Types of Out-Of-Service...
- Colorado trucking industry group supports electronic on-board recorders
Posted May 7, 2008, 2:10 pm
As a Georgia lawyer representing people who are hurt in trucking accidents - and the families of those who are killed - I see too many cases where it appeared that a truck driver was deeply fatigued, was over the legal hours of service, and had a paper log that was not accurate. A study by the Federal Motor Carrier Safety Administration showed 13% of large truck drivers were fatigued at the time of an accident. Of the 141,000 estimated crashes, that's 18,000 fatigued truck drivers causing...

The State Bar of Georgia election ballots have been counted. I will be Secretary of the State Bar beginning in June. When you see a turtle on a fence post, you know somebody put him there. A lot of hard working Georgia lawyers put me on this fence post. For them, I will keep my focus on practical, nuts and bolts matters affecting the everyday practice of law. - MRSA Infections in Hospitals and the Community Continue to Rise
Posted May 5, 2008, 9:56 am
MRSA is a staph becteria which has been in the news in recent years as serious problems have been reported in hospitals and other health care facilities. Staph bacteria, even those that aren't resistant to antibiotics, have long caused serious infections. In the 1960s, the first reports surfaced of staph infections that had stopped responding to the antibiotic methicillin. Over the decades, those strains have spread, and the germs have developed resistance to other drugs, largely in hospitals...
