What is Collaborative Law As It Applies to Divorce?

Collaborative law is a new trend in divorce where the lawyers representing the divorcing parties commit to reaching a settlement and refraining from litigation. If the divorcing spouses and their collaborative attorneys cannot reach a settlement, the attorneys are replaced by new counsel. The theory is that the first set of lawyers will try harder to reach a settlement if they know that they will be "fired" if a judge must resolve the dispute.
