Effective November 1, 2008, I opened my own law office in Brookfield, Wisconsin (in Waukesha County, a suburb of the City of Milwaukee). In addition to being more centrally situated to my personal client base, this move also reflects the fact that as my practice was increasingly focused on asset planning and debt reorganization, it resulted in my former law firm more frequently encountering conflicts of interest with business organizations and financial organizations it represented (or, desired to represent!). Generally, I will continue to provide services in the following areas of concern as they tend to interact, and at the...

I often tell clients that usually when you think you need a lawyer, it is probably too late. In many situations, consulting an attorney as soon as possible may save you time, money, and difficulty on the back end. In my practice, I routinely help clients avoid problems down the road. However, some problems may be unavoidable and people find themselves in situations where they need the immediate help of an attorney. For example, I primarily work as a criminal defense attorney. Just because you have been accused of a crime does not mean you are guilty; nor...

Facing a legal issue can be a trying and scary time. Our laws and legal system often appear confusing and, at times, unjust. My goal as an attorney is to make the legal system more accessible by helping clients understand their rights. Each client has a unique situation that deserves individualized and personal attention. Keeping these things in mind, the client is always my number one priority. I listen to each client to determine his or her individual needs and expectation. I promptly return phone calls and emails to answer any questions or concerns a client may have. Finally, I...

Problems in the workplace?

Employment law governs the relationship between workers and their employers. This law, contained in federal and state statutes, administrative regulations, and judicial decisions, specifies the rights and restrictions applicable to each party in the workplace.

This area of law regulates such issues as employee benefits, discipline, hiring, firing, leave, payroll, and health and safety in the workplace. It also encompasses non-compete agreements, retaliation, severance, unemployment compensation, pensions, whistle-blowing, worker classification, wage garnishment, work authorization for non-U.S. citizens, worker's compensation, and employee handbooks.

Both federal and state laws govern the relationship between employees and employers. Federal laws such as Title VII, the Americans with Disabilities Act, and Age Discrimination in Employment Act prohibit employers from discriminating against employees based on certain characteristics. Many states have enacted their own laws similar to federal ones (and sometimes are more stringent). Cities and counties also can enact ordinances that affect employee rights, such as local minimum wage laws.

Employment lawyers can choose to accept only employees as clients, only employers, or both. Some attorneys focus on a specific area of employment law, such as workers' compensation, whistleblowing or discrimination, but many can handle a wide range of employment law issues.

Essential job functions: The fundamental job duties of the employment position that the individual with a disability holds or desires. The term essential functions does not include marginal functions of the position.

Exempt employee: An employee who is not entitled to the minimum wage or overtime pay protections of the Fair Labor Standards Act.
