Getting a Marriage License: 50-State Survey
Couples planning to get married typically must obtain a marriage license from the state, and sometimes the locality, where they will be married. The process for acquiring a marriage license varies but broadly involves appearing together and in person at a government building, presenting a valid ID, and filling out an application containing information about both parties. Obtaining a marriage license is important because a marriage performed without a license when required is generally void.
Marriage licenses often have expiration dates and sometimes waiting periods. Expiration dates mean that a couple can only obtain a marriage license a few months and sometimes as little as one month ahead of time. Waiting periods mean that there will be a few days between when a couple applies and when they can pick up or use their license. In addition to legal waiting periods, couples should factor in practical processing times for obtaining a license. It will usually make sense to acquire a marriage license at least a few days ahead of the ceremony date in case there are any problems during the application process.
In most circumstances, it is the responsibility of the person who performs the marriage ceremony to return the marriage license to be recorded. It may also help couples estimate when they will be able to request a certified copy of their marriage certificate if they do not receive one automatically.
Fees may vary by state and county but typically range from $20 to $120. Other application requirements also vary, including acceptable forms of identification, although a state driver’s license, U.S. passport, or birth certificate are often valid documentation. Parties must also usually provide their Social Security numbers. If a party is divorced, they may be asked to provide the date the marriage ended or a copy of their divorce decree.
